Subject: [ROOTS-L] Certainty in Research (2)

I am requesting opinions and definition concerning a legal question of proving  certainty of paternal and maternal grandparents and their descendants.   Issue:  A man dies with no wife, children or other descendants, no mother or father, no brothers or sisters.  His estate would be divided into the paternal and the maternal kindred in the following manner:
To the Grandfather and Grandmother, equally; (Father’s mother and father & mother’s mother and father)
If no Grandparents, then in two equal parts to the descendants of such deceased Grandfather and Grandmother.

My question of  certainty relates to both source documents and degree of research necessary and essential.
