I never submitted  any data to Ancestry, yet I have had it for years and my
data is on there in  many different trees at different stages of my searches.
It doesn't give my  name but it certainly is my data--even my errors before
corrections!
How  do they get away with this and what can we do about  it?

Who is "they?"  Ancestry does not "take" anyone's data. We've  thoroughly 
covered this topic on the list recently and many times in the  past.  People 
SUBMIT the data someplace.  If you didn't submit your  family tree to Ancestry 
specifically you submitted it *somplace* or to other  people who, in turn, added 
it to their trees.  
 
Did you perhaps submit a tree to World Family Tree via FTM?  If so,  then it 
was published on CDs and you will many other researchers incorporating  your 
data into their files and citing your WFT file as their source.  
 
If you tell us a bit more (in detail) so that we can check out the files to  
which you refer, then we could probably give you a better answer as to how 
your  data ended up where you are finding it.  But Ancestry most definitely  
didn't "take" your data.  Someone or more than one  person submitted it.
