  Yes, I have found a couple of records for children in  my tree where the 
mother is listed as the children's guardian on legal  papers.  As I recall the 
records were in the 19th century.   
One of the tricks to this is finding a census record and  checking for the 
mother's place of birth and then seeing if that matches  for the children's 
mother's place of birth.
